These terms govern sales contracts for original paintings made through yaniart.pl, operated by Janina Vakhovich (YANI ART), based in Warsaw, Poland.
1. Seller and contact details
The seller is Janina Vakhovich, trading as YANI ART. Contact: contact@yaniart.pl. All prices shown are final prices, in Polish złoty (PLN) or, for selected markets, in euro (EUR).
2. Nature of the works and copyright
Every painting is an original, handmade work — one of one, never a reproduction. Buying a painting transfers ownership of that specific physical object, but not the copyright in it. The artist retains copyright, including the right to publish photographs of the work in her portfolio, marketing materials, and on social media, unless otherwise agreed.
3. Placing an order
You may order as a guest or while signed in. The sales contract is formed once your order is confirmed and payment is accepted. Before confirming, you can review the order, including price and shipping details.
4. Payments
Payments are handled by a third-party processor (Stripe) — the store never stores your card details. Orders are fulfilled once payment is confirmed.
5. Fulfilment and shipping
Ready works are usually packed and shipped within 2–5 business days of ordering; commissioned pieces have an individually agreed timeline. Full delivery details, costs, and destinations are described on the “Shipping & returns” page.
6. Right of withdrawal
Consumers in the EU generally have a 14-day right of withdrawal from a distance sale, without giving a reason, under EU consumer protection rules. This right does not apply to works produced to your individual specification — this covers commissioned ("na zamówienie") paintings. See the “Shipping & returns” page for details.
7. Complaints and statutory warranty
The seller is liable for defects under the statutory warranty rules applicable under Polish law (generally 2 years from delivery). Complaints can be sent to contact@yaniart.pl and are handled within 14 days.
8. Personal data
How customer data is processed is described in the Privacy Policy.
9. Final provisions
Matters not covered by these terms are governed by Polish law, applied consistently with EU consumer protection standards. Consumers may also use out-of-court dispute resolution, including the EU's ODR platform (ec.europa.eu/consumers/odr).
